Environment Agency given civil powers to fine businesses
The Environment Agency and Natural England have been granted civil powers to enforce environmental law, under the Regulatory Enforcement and Sanctions Act 2008.
The move is designed to provide an alternative to criminal prosecutions, which are often disproportionate as the majority of businesses unintentionally fail to comply with regulations. The civil sanctions include fixed monetary penalty notices and variable monetary penalties.
