TUPE ruling could mean more unfair dismissal claims, expert warns
A ruling under the Transfer of Undertakings (Protection of Employment) Regulations (TUPE) may make it easier for employees to claim unfair dismissal if they have suffered 'material detriment', according to law website Out-Law.com.
The ruling centred on an employee who was transferred to another place of work and found it affected her childcare arrangements and journey plan. The employee claimed unfair dismissal but this was rejected by an Employment Appeals Tribunal. However, this was subsequently overruled. A spokesman for Pinsent-Masons, the law firm behind Out-Law.com, said the original ruling was looked at "from the wrong standpoint".
