HMRC wins court battle on National Minimum Wage

HM Revenue & Customs (HMRC) has won its legal battle with a London nightclub after the Court of Appeal ruled that employers cannot use tips to "top up" staff wages to the NMW.

The court ruled against Annabel's nightclub, which paid part of staff wages using tips paid by customers. From October all employers will be banned from using tips, gratuities and service charges to make up staff pay and meet the NMW.
