Criminal prosecution under National Minimum Wage Act

The owner of a children's nursery has been prosecuted in the first criminal case to be taken under the National MInimum Wage Act.

GNN reports that a fine of £2,500 was imposed on the proprietor of Rascals Day Nursery Ltd in Walthamstow, London, after she was convicted of obstructing H M Revenue & Customs (HMRC) in their attempts to examine staff records to ensure that they were being paid the minimum wage. She was later prosecuted by the Revenue and Customs Prosecutions Office (RCPO).

Andy Millican, Criminal Investigation Team Leader for HM Revenue & Customs said:

"This prosecution sends a clear message to employers that HMRC and RCPO will actively pursue those we suspect of flouting National Minimum Wage law. If employers obstruct us and refuse to comply with the law they could receive a fine and a criminal record."
